The short version: you must be of legal drinking age, the allocation list is not an order, and wine shipping follows the law of the state it is going to. The details are below.

1. Acceptance of these terms

These Terms of Use (the “Terms”) govern your use of 1991estate.com (the “Site”), which is operated by 1991 Estate (“1991,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Legal drinking age

The Site is for adults of legal drinking age only: 21 or older in the United States, and the legal age in your own jurisdiction if it is higher. The age confirmation on our home page is a courtesy and is not verification of your age. By using the Site you represent that you are of legal drinking age.

Alcohol may be delivered only to an adult of legal drinking age, and an adult signature is required on delivery. We may ask you to verify your age at any time, and we may cancel any order or allocation if we cannot.

3. Please enjoy responsibly

Please drink responsibly. Never drink and drive, and do not drink during pregnancy.

Our wines contain sulfites.

4. The allocation list

Our wines are made in very small quantities. Joining the allocation list lets us contact you about upcoming releases. It is not an order, a reservation or a guarantee that any wine will be offered to you. Offers are made in the order we judge appropriate, which is generally the order in which people joined, and are subject to availability and to the limits we set on each release. We may change, suspend or end the allocation list at any time.

5. Orders, pricing and availability

Prices on the Site are in U.S. dollars, are per 750 ml bottle unless stated otherwise, and exclude shipping, handling and applicable taxes. Prices, vintages, quantities and availability can change without notice. Information on the Site is not an offer to sell, and we may decline or cancel any order, including for an error in price or availability, a purchase limit, or a compliance concern. Where an offer is made, it will state the terms of purchase.

6. Shipping and compliance

The sale and shipment of alcohol is regulated by federal law and by the laws of each state, and those laws differ widely. We can ship only to states where we are licensed or otherwise permitted to do so, and only to the extent the law allows. Some states limit the amount an individual may receive, and some prohibit direct shipping entirely.

You are responsible for ensuring that you are legally permitted to receive alcohol at the delivery address. Wines purchased from us are for personal use and are not for resale. Wines may also be offered through licensed wholesalers, distributors and retailers under the three-tier system, and in that case your purchase is governed by the terms of the seller. Nothing on the Site is an offer to sell or solicitation to buy in any place where it would be unlawful.

Risk of loss passes to you on delivery to the carrier. Wine can be damaged by heat and cold in transit; we recommend that you arrange delivery when an adult can receive it. If an order arrives damaged, contact us promptly with photographs and we will work with you in good faith.

7. About the wines

Wine is an agricultural product, and vintages differ. Tasting notes, technical details, ratings and descriptions on the Site reflect our opinion at the time they are written and are provided for information only. Labels, packaging, vintages and blends may differ from what is pictured or described.

8. Intellectual property

The Site and its contents, including the names 1991, Semper, Locus and Tempus, labels, logos, artwork, photographs, text and design, belong to 1991 or its licensors and are protected by trademark, copyright and other laws. You may view the Site for your personal use. You may not copy, reproduce, modify or use anything on it for commercial purposes without our written permission.

9. Acceptable use

You agree not to:

• use the Site unlawfully, or to buy or obtain alcohol for or on behalf of anyone under legal drinking age;
• use bots, scrapers or other automated means to join the allocation list or place orders, or to get around limits we set;
• interfere with the Site’s operation or security; or
• submit information about anyone other than yourself without their permission.

10. Third-party links

The Site may link to other websites, including retailers and press. We do not control them and are not responsible for their content or practices.

11. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted or error free.

12. Limitation of liability

To the fullest extent the law allows, 1991 and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or the wines. Our total liability for any claim relating to the Site or an order will not exceed the amount you paid us for the wine at issue. Some jurisdictions do not allow certain limits, so some of this may not apply to you.

Our wines are produced in California.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from them will be brought in the state or federal courts located in California, and you consent to their jurisdiction.

15. Changes to these terms

We may update these Terms from time to time. The date at the top shows when they last changed. Continuing to use the Site after a change means you accept the new Terms.
